These Terms apply to:
- any person browsing the website alcageb.com (hereinafter the "User"); and
- any individual subscribing to one or more services offered by Alcageb (hereinafter the "Client").
These Terms apply exclusively to relationships between Alcageb and individual clients (B2C). Any commercial relationship between Alcageb and a business or organization (B2B) will be governed by a separate written agreement.
3.1 Access to the Website
The website alcageb.com is freely accessible to any user with an Internet connection. Alcageb Inc. shall not be held liable for access difficulties attributable to the user's network infrastructure, a hosting outage, or any circumstance beyond its reasonable control.
Alcageb Inc. reserves the right to suspend, modify, or discontinue access to the website, in whole or in part, at any time and without prior notice, including for maintenance, updates, or security purposes.
3.2 Acceptable Use
Users agree to use alcageb.com in a lawful manner and in accordance with these Terms. The following are strictly prohibited:
- Reproducing, copying, selling, or commercially exploiting any website content without the prior written authorization of Alcageb Inc.;
- Attempting to compromise the security, integrity, or availability of the website;
- Using automated systems (bots, scrapers) to collect data from the website;
- Posting or transmitting any defamatory, fraudulent, or unlawful content.
3.3 Intellectual Property
All content on alcageb.com, including texts, visuals, logos, site architecture, methodologies, tools, and documents, is the exclusive property of Alcageb Inc. or is used under licence, and is protected under applicable Canadian and Quebec copyright laws.
Any reproduction, distribution, or use, even partial, without prior written authorization is strictly prohibited and may result in civil and criminal liability.
5.1 Formation of Contract
The service contract is deemed concluded at the time the Client completes the online payment process through the Stripe platform and receives a transaction confirmation.
5.2 Pricing and Taxes
All service prices are displayed in Canadian dollars (CAD), excluding applicable taxes. Alcageb Inc. collects and remits Goods and Services Tax (GST) and Quebec Sales Tax (QST) in accordance with applicable Canadian and Quebec tax laws, based on the company's registration status and the Client's place of residence.
Prices in effect are those displayed on alcageb.com at the time of purchase. Alcageb Inc. reserves the right to modify its pricing at any time, without affecting previously confirmed orders.
5.3 Payment Terms
Full payment is due at the time of purchase, in a single instalment, by credit or debit card through the secure platform Stripe Inc. No instalment payment plans are available unless separately agreed in writing.
Alcageb does not collect or retain any payment card data. All transaction processing is handled exclusively by Stripe Inc., which is PCI-DSS certified.
5.4 Order Confirmation
Upon receipt of payment, the Client will receive a confirmation email at the address provided during the transaction. This email serves as the order acknowledgement and payment receipt.
6.1 Delivery Timelines
Alcageb commits to delivering the Express Assessment report within five (5) business days of receiving the complete required documents (CV and job description). The IT Canada Application Sprint report is delivered within forty-eight (48) hours of Session 2. Any delay caused by the Client's late submission of documents or rescheduling of a session is the sole responsibility of the Client.
6.2 Session Validity
The following services are subject to a fixed validity period from the date of purchase or first session:
- IT Canada Application Sprint: Session 2 must be booked within 30 days of Session 1. After this period, the right to Session 2 is forfeited; the service is deemed fulfilled on the basis of Session 1 alone.
- 1:1 Coaching: 3 sessions to be used within 30 days, extended by ten (10) days for each additional session purchased.
Sessions not used within the applicable validity period are forfeited and are not eligible for a refund or extension, except in exceptional circumstances accepted in writing by Alcageb.
6.3 Client Obligations
To enable proper service delivery, the Client agrees to:
- Provide accurate, complete, and up-to-date information at the time of booking and throughout the engagement;
- Submit required documents by email within the agreed timelines;
- Attend scheduled sessions on time; any missed appointment without at least 24 hours' notice will be counted as a used session;
- Participate actively and in good faith in the coaching process.
6.4 Alcageb Obligations
Alcageb commits to:
- Delivering the described services with professionalism, diligence, and within agreed timelines;
- Maintaining the strict confidentiality of all information provided by the Client;
- Communicating with the Client in the agreed language of service;
- Promptly notifying the Client of any circumstance that may affect the quality or timing of service delivery.
Detailed cancellation and refund terms are set out in a separate Cancellation and Refund Policy, available on alcageb.com and incorporated into these Terms by reference.
The following principles apply:
- All cancellation requests must be submitted by email to info@alcageb.com.
- A full refund is provided if the cancellation is received before service delivery has commenced (report delivery or first session, whichever occurs first).
- No refund is issued once service delivery has commenced, except in cases of material failure attributable to Alcageb.
- Unused sessions that expire within the validity period are not refundable.
Alcageb provides professional career support services based on the expertise and judgment of its advisors. Alcageb's services constitute a best-efforts obligation and not a guarantee of results. Alcageb makes no warranty regarding the Client's prospects of obtaining employment, interviews, or any other specific outcome following the delivery of its services.
To the fullest extent permitted by applicable law, the total liability of Alcageb Inc. to the Client, for any cause whatsoever and regardless of the form of action, shall not exceed the amount paid by the Client for the service in question during the preceding twelve (12) months.
Alcageb Inc. shall not be liable for any indirect, consequential, incidental, or punitive damages, including without limitation loss of revenue, data, or professional opportunities.
Alcageb processes all personal and professional information provided by the Client solely in the context of the agreed service engagement. Such information is not disclosed to any third party without the Client's prior consent, except as required by law.
The processing of personal information is governed by the Alcageb Inc. Privacy and Cookie Policy, available at alcageb.com and incorporated into these Terms by reference.
By providing an email address at the time of booking or purchasing a service, the Client consents to receiving operational communications from Alcageb related to their order (confirmation, delivery, session follow-up).
Any commercial or marketing communications are subject to separate express consent in accordance with Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23). The Client may unsubscribe at any time by replying to any commercial email with the word "Unsubscribe" or by writing to info@alcageb.com.
Alcageb Inc. reserves the right to amend these Terms at any time. Amendments take effect upon publication on alcageb.com. Clients are encouraged to review this page periodically. Continued use of the website or services following publication of amendments constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the applicable federal laws of Canada, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec, judicial district of Montreal.
Prior to initiating legal proceedings, the parties agree to attempt in good faith to resolve any dispute through direct negotiation within thirty (30) days of written notice of the dispute by the initiating party.
Clients residing in province of Quebec benefit from the protections afforded by the Consumer Protection Act (CQLR, c. P-40.1). Nothing in these Terms shall be construed to limit or waive those rights.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy and Cookie Policy and the Cancellation and Refund Policy, constitute the entire agreement between the Client and Alcageb Inc. with respect to the use of the website and Career Transition Canada services offered by Alcageb, and supersede all prior agreements on the same subject matter.
